Loyalty Program Policy

1. Introduction and Acceptance
  • Program Name: BUJUKU Loyalty Program (the "Program") is a customer loyalty program offered by BUJUKU/ SKAVI Fashions (the "Company" or "We").

  • Applicability: This Policy governs the earning, accumulation, redemption, and expiration of loyalty points ("Points") and rewards/coupon codes ("Rewards" or "Coupons") under the Program.

  • Acceptance: By enrolling or participating in the Program, you (the "Member" or "You") agree to be bound by this Policy and our general Terms and Conditions and our Privacy Policy.

 

2. Earning Points
  • Eligibility: Points are generally earned on the purchase of eligible goods and services on our webstore, excluding taxes, shipping fees, and purchases made using gift cards or previous Rewards.

  • Earning Rate: Members earn (e.g., 1 Point) for every (e.g., ₹100) spent on eligible purchases as mentioned on the Loyalty Program page.

  • Other Earning Activities: The Company may offer additional ways to earn points (e.g., sign-up bonus, product reviews, social media sharing) as detailed on the dedicated Loyalty Program page.

  • Non-Accrual: Points will not be earned on cancelled, refunded, or fraudulent transactions. Points may be deducted from your balance for any returned or refunded items associated with the original earning.

 

3. Redemption and Rewards (Coupons)
  • Redemption Mechanism: Points can be exchanged for Rewards, which are typically issued as discount coupon codes for future purchases.

  • Redemption Value: Specific Values (e.g., 1000 Points) can be redeemed for a Specific Reward (e.g., ₹20 discount) or a Specific Percentage (e.g., 10% off). The current Rewards catalog, redemption rates, and any specific terms will be displayed on the Loyalty Program page.

  • Types of Rewards: Rewards may include:

    • Fixed discount (e.g., ₹50 Off)

    • Percentage discount (e.g., 10% Off)

    • Free Shipping

    • Specific Free Product (subject to availability)

  • Coupon Usage Conditions:

    • Each Coupon is for single use only.

    • Coupons are not transferable or redeemable for cash.

    • A Coupon may have a minimum purchase value requirement (e.g., minimum cart value of ₹500).

    • Coupons cannot be combined with other offers, discounts, or promotions unless explicitly stated otherwise.

 

4. Point and Reward Expiration
  • Point Expiry: Points will expire if they are not redeemed within 180 days from the date they were earned. Members will be notified via email approximately 15-30 days before expiration.

  • Reward/Coupon Expiry: Once a Coupon is generated (redeemed for Points), it must be used within 30 days of issuance.

 

5. Legal Compliance (Applicable Indian Law)
  • No Element of Chance (Lottery): The Program is based purely on the Member's purchases and specified, quantifiable actions (e.g., sign-up, review submission). The awarding of Points and Rewards does not involve any element of chance, lot, or draw. This is to avoid classification as a "Prize Scheme" or "Lottery" under various state laws and other similar state-specific regulations.

  • Goods and Service Tax (GST): The issue of Points and the redemption of Rewards (discounts/coupons) will be treated as per the prevailing GST laws and rules in India. The final invoice amount, after the application of any discount/coupon, will be the basis for GST calculation and compliance.

  • Closed System PPI: The loyalty points issued are Closed System Prepaid Payment Instruments (PPIs) as defined by the Reserve Bank of India (RBI), as they can only be redeemed for the purchase of goods/services from the Company's webstore and are not redeemable for cash or usable on any third-party platform. Therefore, the Program is generally exempt from the RBI's regulations for open-system PPIs.

 

6. Program Modifications and Termination
  • Right to Change: The Company reserves the right to, at its sole discretion, modify, suspend, or terminate the Program, this Policy, the earning rates, and/or the Reward structure at any time.

  • Communication of Changes: Any material changes to the Policy will be communicated to Members through an updated post on our website's Loyalty Program page. Continued participation after such changes constitutes acceptance of the new terms.

  • Termination: In the event of Program termination, Members will be given a reasonable time, not less than 30 days, to redeem their existing points/rewards.

 

7. Disputes and Governing Law
  • Dispute Resolution: Any disputes arising out of or in connection with the Program or this Policy shall first be attempted to be resolved amicably.

  • Governing Law and Jurisdiction: This Policy and the Program shall be governed by and construed in accordance with the laws of India, and the courts in Tiruppur, Tamil Nadu, India shall have exclusive jurisdiction over any proceedings.

 

8. Member Communication

The Member is responsible for keeping their contact information, particularly their email address, up-to-date to receive notifications regarding their Point balance, Rewards, and Policy changes.
